We're ignoring Tom Delay. this will prove to be perilous. consider that a large number of people have sincere grievances with the federal judiciary. Tom DeLay is the loudest most powerful critic of the federal judiciary. The latest salvo at Justice Kennedy should be taken as a dangerous ploy for us. Not for him, us (by us, I mean me. I speak for me, really, not anybody else. but there's other people who are critical of DeLay, so us might be o.k.). The reason is a tad convoluted and it's 1230am still putting the pieces together... so ymmv.
some thoughts:
1. lots of republicans hate the judges
2. lots of radical religious rightists (beyond party affiliation) really hate the judges.
3. Tom DeLay is in serious ethics trouble and many people are calling for him to quit. the loudest calls are from the left. some on the right think he should go, but they're quiet, reserved.
4. Tom DeLay is seriously and increasingly critical of the judiciary
5. many people who are angry at judges feel disenfranchised and victimized.

conservative voter/man-on-the-street thinking right now as we speak...

.oO(Tom DeLay is the only person who understands me. Not even Bush listens to my pleas for pro-life once the cameras are off him. Tom DeLay is standing up to these liberal judges and look at the price he has to pay in the liberal media. They're crucifying him.)

.oO(Anyone who criticizes Tom DeLay must also like the federal judiciary.)

VOILA! .oO(The problem is these people criticizing our government officials like Tom DeLay who are protecting us from these activist judges. He's not unreasonable, they're just suppressing our views. How could we finally solve the liberal problem?)

bang. Tom DeLay is innocent, federal judges are to blame, people who support the federal courts are members of al Qaeda. (except the federal courts' sentencing guidelines for drugs. that part of the system is okay by the conservatives.)

lather rinse repeat
intensify accuse arrest bury forget deny

Basically, my point is, this DeLay deathwatch is going to backfire. Badly.
